WHO ARE WE?
Kantar Media Philippines, Inc. (“KANTAR MEDIA”, “We”, “Us”, “Our”), a corporation duly organized and existing under the laws of the Philippines, with principal office 4TH Floor Kalayaan Center, V. Luna Road corner Kalayaan Avenue, Barangay Pinyahan, Quezon City. Kantar Media Philippines Inc. is herein referred as the “Personal Information controller” and its Privacy Notice can be accessed thru https://www.kantar.com/cookies-policies.
We at KANTAR MEDIA respect the privacy and confidentiality of Personal Information in our possession or under our control. We have implemented policies and practices to safeguard the collection, use, disclosure, storage, and other processing of Personal Information provided to us.
We will not process your Personal Information unless:
- a) we process it for a lawful purpose directly related to our business activity and the processing is necessary for, or directly related to, that purpose; and
- b) the Personal Information is adequate but not excessive in relation to that purpose.
This Privacy Policy explains how we collect, store, and use the Personal Information you provide during recruitment and updates of your Personal Information via face to face or telephone interview. We encourage you, the Panelists and respondents to carefully read this Privacy Policy. By accepting these terms, you confirm that you have read the terms of this Privacy Policy.
HOW AM I BEING INVOLVED?
As a Panelist or respondent, you are herein referred to as PERSONAL INFORMATION SUBJECT and hereby asked of your CONSENT in the usage of your Personal Information.
We recruit Panelists (the “Panel”) which are representative groups of homes who complete a specific study over a period of time. The participants in these Panels are referred to as “Panelists”.
We collect Panelists’ Personal Information by installing a Peoplemeter, a device used to collect viewing data of the home, into all the working television sets in the household. Daily viewing of the members of the house are being collected by sending the audio collected by the Peoplemeter thru GPRS to our Personal Information collection servers.
We also interview individuals for ad hoc studies, which are representative of a group of homes or individuals which we refer as Respondents. These are interviewed for a shorter period of time, i.e. one time or possibly for a continuous 7-day interview depending on the need of the service.
The Personal Information is being collected by the Kantar Media Philippines, Inc. thru its third-party suppliers and/or by the Kantar Media staff. Before collection, a consent/agreement form will be provided by the Panel Home Household Head or Housewife. All members who are 18 years old and above will likewise sign a consent form, while the parent/guardian will sign on behalf of those respondents below 18 years old.
Only the authorized personnel are allowed to ask for your Personal Information on behalf of Kantar Media:
- a. Field Interviewer wearing ID coming from commissioned vendor/supplier;
- b. Group Leaders wearing ID coming from commissioned vendor/supplier;
- c. Kantar Media Philippines’ Panel team who, will contact you through phone calls.
- d. Kantar Media Philippines’ Technicians who will visit your homes to troubleshoot.
- e. Kantar Media Philippines’ Executive and Managers who will visit you any time together with the Field Interviewers, Panel team staff and Group Leaders
WHAT PERSONAL INFORMATION ABOUT ME ARE BEING PROCESSED?
The types of Personal Information we collect about you and process (or have a service provider process on our behalf) may include:
- a. Full Name
- b. Gender
- c. Birthday / Age
- d. Occupation
- e. Marital Status
- f. Educational Attainment
- g. Religion
- h. Home Location
- i. Contact Details including landline, mobile number and email addresses
- j. Household Income
- k. Viewing data of the household
WHY ARE WE COLLECTING YOUR PERSONAL INFORMATION?
We are collecting your Personal Information primarily to understand your and your household’s viewing behavior. All household members’ Personal Information are then anonymized and aggregated with similar demographic groups, and our analysis are then shared to our clients for the purpose of understanding media specifically TV Viewing and to improve their business.
We may also collect your Personal Information for other general purposes, such as, communication, eligibility confirmation, internal processes, and incentivization, which may include:
- Contacting via telephone calls, SMS, or any other proposed communication options
- Sending a newsletters
- Providing you with your points or incentives
- Scheduling home visits for checking of our equipment
- Getting additional information from your households
WHO WE DISCLOSE PERSONAL INFORMATION ABOUT YOU TO?
We disclose or share some of the Personal Information we have collected about you to the following classes of parties or organizations outside KANTAR MEDIA:
- Field vendors for recruitment and update of demographic information
- Vendor for panel incentives handling
- Data processing vendors
WHAT CONTROLS ARE USED TO ENSURE YOUR PERSONAL INFORMATION IS SAFE?
We may process Personal Information about you if the processing is necessary:
- for the performance of a contract between you and us
- for taking steps at your request with a view to entering into a contract
- for compliance with any legal obligation to which we are subject (other than an obligation imposed by contract)
- to protect your vital interests (which means matters relating to your life, death or security)
- for the administration of justice and
- for the exercise of functions conferred on any person or under any law.
Otherwise, we will obtain your consent prior to collection or processing.
Upon joining our Panel:
- We will only publish summarized and aggregated reports about viewing behavior. These reports will never identify any individual and/or household details.
- We may share your Personal Information with third-party service providers for quality checking purposes.
- Your Personal Information will be collected, stored, transferred, or processed by our division.
- The collected Personal Information from you will be used for Panel management and reporting of aggregated Personal Information to clients.
- All our employees are contractually obliged to follow our policies and procedures regarding confidentiality, security, and privacy.
- We take appropriate technological and organizational measures to protect the Personal Information submitted to us, both during transmission and once we receive them.
- We assure our Panelists that our security procedures are consistent with generally accepted commercial standards used to protect and respect Personal Information.
- We take all reasonable steps to keep Personal Information in our possession or control
We have implemented an Information Security Policy that governs how we protect personal data.
We take practical steps to protect personal data from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction having regard to the nature of the personal data and the harm that would result from any such thing happening, the place or location where we store the personal data, any security measures incorporated into any equipment in which the personal data is stored, to the measures taken for ensuring the reliability, integrity and competence of the personnel having access to the personal data and to the measures taken for ensuring the secure transfer of the personal data.
Entities that provide services to us to process personal data on our behalf will be bound by contracts with us that require them to provide sufficient guarantees in respect of the technical, physical and organizational security measures governing the processing to be carried out and to take reasonable steps to ensure compliance with those measures.
Obtaining Consent
Personal Information about you that we process may or may not be sensitive Personal Information, such as information about your race, ethnic origin, political opinions, your religious beliefs or other beliefs of a similar nature, about your physical or mental health or condition, the commission or alleged commission by you of any offence as well as any government issued identification such as social security numbers, licenses, etc.
We will not process any sensitive Personal Information about you unless we get your express consent to do so and the processing is necessary for a purpose permitted by law. Please contact us if you would like information about these purposes.
Where we obtain consent from you, whether or not the Personal Information is sensitive Personal Information, we will tell you whether it is obligatory or voluntary for you to supply the Personal Information, and where it is obligatory, the consequences for you if you fail to supply the Personal Information.
HOW CAN YOU LIMIT THE PROCESSING OF PERSONAL DATA ABOUT YOU?
Withdrawal of Consent
If you have given us consent to collect, use, disclose, store and otherwise process personal data about you, you may withdraw that consent at any time. You should give us reasonable advance notice of your withdrawal of consent.
Restricting the Processing of Personal Data
You may also give us notice in writing at any time telling us to suspend, withdraw or order the blocking of personal information for a specified purpose or in a specified manner. This may also include removal or destruction of your personal information in our care. Do note that there will be instances where we may not be able to do so because of legal, regulatory or legitimate business reasons, in which case, we will inform you.
Your request for the withdrawal of consent or restrict any processing activity can take the form of an email or letter to us, or through the UNSUB feature in an online service. Where relevant, we may need you to provide proof that the personal information are incomplete, outdated, false, unlawfully obtained, used for unauthorized purposes or are no longer necessary for the purposes for which they were collected.
We will then notify you of the likely consequences of your withdrawal of consent, e.g. without your personal contact information we may not be able to inform you of future updates or that the quality of our service may be impacted.
Please take note that we would comply with your notice within a reasonable time.
Accessing and Making Correction to Personal Data About You
You may ask us (in writing) to inform you what personal data we hold and relevant details about what is being processed by us or by a service provider on our behalf for a particular purpose and, if you say that you would like to receive it, to give you a copy of that personal data in an intelligible form and in a form that is easily portable.
You need to ask us separately for such access to personal data that we hold for each different purpose. We may charge you a reasonable fee for each access request you make to us if there is a cost involved.
We will respond to your request for access to personal data about you within a reasonable time framework after we receive the request from you. If we are not able to do so fully within that period, we will let you know the reasons, comply with the access request to the extent that we are able to do so and comply with it fully as soon as we are able to, after we receive the request from you.
When you make such a request, we may need to verify your identity – for example, by checking your valid ID or other legal identification document.
Accuracy of Your Personal Data
We will take reasonable steps to ensure that the personal data we collect about you is accurate, complete, not misleading and kept up-to-date by having regard to the purpose, including any indirectly related purpose, for which we collect the personal data and further process it.
You may ask us to correct personal data about you where the personal data is inaccurate, incomplete, misleading or not up-to-date. Where we are satisfied that the correction should be made, we will make it within a reasonable time framework from the date we receive your request and give you a copy of the corrected personal data.
From time to time, we may do a verification exercise for you to update us on us on any changes to the personal data we hold about you. If we are in an ongoing relationship with you, it is important that you update us if there are any changes in the personal data we hold about you (such as a change in your personal address).
RETENTION PERIOD
- If you are still part of the Panel, your Personal Information will remain in our system and will continue to be processed.
- If you are not a part of our Panel anymore, all your Personal Information will be anonymized after three months.
- Sheets will be destroyed after 1 year of retention after the Panel home is pulled out from the active Panelists.
- In case of ad hoc studies, sheets and files containing Personal Information shall be destroyed after a year the Personal Information is released.
TRANSFER OF PERSONAL INFORMATION
If there is a need for us to transfer personal data about you to a place outside the Philippines we ensure that the recipient will be obliged to provide a standard of protection to such transferred data that is comparable to the protection it receives under Philippine law.
Otherwise, we are allowed to transfer personal data about you in various circumstances permitted by law (for example, for the purpose of a contract between you and us or in an emergency concerning you). If you would like more information about these circumstances, please let us know.
QUERIES OR COMPLAINTS
Kantar Media Philippines, Inc. aims to meet the highest standards when collecting and processing Personal Information. We encourage our Panelists to message if you think our use of your Personal Information is unfair, misleading or inappropriate. We also welcome suggestions to improve further our way of doing things. You can notify us thru email at melanie.cugay@kantar.com or call our numbers 63-9178105126. You can also inform us in the same line of communication if you (a) do not wish your Personal Information to be used in a manner described above (b) wish to see the Personal Information we hold. If the information is inaccurate, incomplete or irrelevant, we shall correct or delete the Personal Information after we have discussed this with you.
AMENDMENT OF THE PRIVACY POLICY
Our Privacy Policy may change and therefore you should review it regularly. We will notify you of any changes where we are required to do so.
In compliance with the Personal Information Privacy Act of 2012 and its Implementing Rules and Regulations effective September 6, 2016, I hereby allow KANTAR MEDIA PHILIPPINES, INC. to become a responsible partner of Personal Information collection and processing.
